These terms and conditions govern the sale of products by us (Simply Supplements) to you on the simplysupplements.co.uk website. These terms and conditions constitute the entire agreement between Simply Supplements, whose registered address is Third Floor, 37 Esplanade, St. Helier, Jersey, JE2 3QA (VAT Reg No: 202 3743 50) and you the customer. Please read these conditions carefully before purchasing Simply Supplements products. By ordering our products, you signify your agreement to be bound by these terms and conditions.
Items sold by Simply Supplements are dispatched from The Channel Islands. All purchases made by you are completed and performed in Jersey and Jersey law shall govern every aspect of contractual agreement concerning purchases made from us.
Please note that we have no control over any additional charges for customs clearance and cannot predict what these may be at any time in the future. Being the importer of the product(s) you are responsible for these charges and for complying with all laws and regulations of the UK Customs Authorities.
When you place an order on our website to purchase goods from us that constitutes an "Offer to Buy" from you. We accept this order when we send you an "Order Confirmation" (or "Shipment") email confirming that we have dispatched the goods you have ordered from us. That acceptance will be deemed to be complete and communicated to you at the time we send the Confirmation (or Shipment) email, whether you receive that email or not.
Simply Supplements orders are dispatched on the same day (for orders received before 12.30pm) or within 24 hours (subject to stock availability - out of stock items will be dispatched as soon as they arrive).
For next day delivery: Orders placed before 12.30pm Monday to Friday with our Express Delivery Service should arrive with customers on the next business day. Estimated delivery periods exclude bank holidays. UK only.
For standard delivery: All standard orders are delivered using our 2 Day Track & Trace service. The majority of orders placed before 12.30pm Monday to Friday should arrive with customers within 2 business days. On rare occasions, the delivery period may be 3 business days. Estimated delivery periods exclude bank holidays. UK only. European and international delivery times may vary.
Please bear in mind that these delivery times are approximations and during busy periods delivery may be slightly longer.
Goods are dispatched from Guernsey. Please note that in accordance with our terms and conditions, for international orders we can not investigate the non-arrival of goods until 24 working days after the date of dispatch.
Please note: We are unable to deliver to PO BOX addresses when orders are placed using our standard 2 day delivery service, as our couriers do not provide this service.
If you would like your goods delivered to a PO BOX address please select next-day delivery when placing your order. All orders placed using next-day delivery are dispatched with a different courier, which can deliver to PO BOX addresses.
Postage & Packaging Charges
Standard delivery to UK addresses: FREE on all online orders
Express Next Day delivery to UK addresses: £5.25 for all orders
European and International delivery: Calculated on weight and size
For all European and International orders, delivery charges will vary depending on the total weight and size of the order. As you add products to your basket the delivery charge will automatically update. With this new service we hope to offer all our international customers fair and competitive delivery charges.
Import Duty and VAT
The prices payable for goods as set out in the web site are, inclusive of VAT and shipping/handling costs for UK buyers. We do not charge for deliveries to the UK. We will arrange for VAT at 20% due on your importation to be paid to HM Revenue and Customs as from 1 April 2012 VAT must be paid on importations of all goods from the Channel Islands into the UK. This procedure is specific for the importations you make into the UK. This arrangement does not change any of the relevant terms and conditions mentioned in this document. For the avoidance of doubt, you are and will remain the importer of all goods ordered by you and shipped to an address outside the Channel Islands and will at all times remain liable for any import VAT, Customs or other duty chargeable thereon. For purchases by UK businesses, no evidence of payment of UK import VAT can be provided. We will, unless you inform us otherwise, arrange for VAT at 20% to be paid to HM Revenue and Customs.
For importations of goods into other EU member states, prices are quoted net of import VAT, customs duty and other levies or taxes. As importer of the goods into these member states you are solely responsible for all import VAT, customs duty, other levies, tariffs or taxes and these may be payable on delivery of the goods to you. EU member states generally allow relief from import VAT for goods of negligible value under €22 imported from non-EU jurisdictions such as the Channel Islands. However, such relief is at the discretion of the authorities of the member states concerned and we cannot guarantee that such relief will be obtained.
We'll send you an invoice/ delivery note setting out the cost of your purchase we have supplied, together with the total cost of postage and packaging if applicable. Our prices and charges are shown in the subscription magazine and on the Website. We reserve the right to request that we receive payment from you before we supply any products to you.
Ownership and Title
All ownership, title and risk of loss and/or damage in the product you have purchased shall pass to you at the point and time at which such product leaves our premises on The Channel Island. All sales are ex works. This means that the sale is completed in the Channel Islands. All goods remain in the Channel Islands before any sales transactions are conducted.
When you transact with Simply Supplements or send e-mails to us, you are communicating with us electronically. We communicate with you by e-mail or by posting notices on the simplysupplements.co.uk website. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your legal rights.
Alteration of Service or Amendments to the Conditions
We reserve the right to make changes to our policies, and these terms and conditions at any time. You will be subject to the policies and terms and conditions in force at the time that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.
Events Beyond our Reasonable Control
We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause which is beyond our reasonable control including but not limited to any statutory changes or rulings by any act or customs authority affecting the customs duty payable by you. This condition does not affect your legal rights.
If you breach these conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.
Governing Law and Jurisdiction
Your relationship with us is governed by and construed in accordance with the laws of Jersey. You agree, as we do, to submit to the non-exclusive jurisdiction of the Courts of the Island of Jersey.
Returns & Refunds Policy
If you return goods to us, unopened, within 3 weeks of the day of delivery we will refund the amount charged. We do advise you obtain proof of posting from your local post office. We regret that no refunds will be given on products already opened. See our Cancellation Policy below for more details.
This Returns Policy does not affect your legal rights.
At Simply Supplements we want you to be delighted every time you shop with us. However, in the event that you wish to cancel your order, under the United Kingdom distance selling regulations, you have the right to cancel the contract for the purchase of the item(s) within a period of 7 working days (commencing from the date the goods are received). This applies to all of our products. However we regret that we cannot accept cancellations for purchases where the item(s) has been opened.

Goods must then be returned unopened within 3 weeks of the delivery date to receive a full refund for your order. All return orders should be sent to the following address:
For your protection, we recommend that you use a recorded-delivery service and obtain proof of posting from your local post office. You must ensure they are packaged adequately to protect against damage. Please note that you will be responsible for the costs of returning the goods to us unless we delivered the item to you in error or the item is faulty.
As soon as we receive the returned unopened item(s), we will refund the relevant purchase price for that item.
Offers on our website may differ from our other promotions. This cancellation policy does not affect your legal rights.
Limitation of Liability
Our liability to you for breaking any of these Terms and Conditions is limited to refunding any money you've already paid for items that you haven't received or that you've returned within the agreed time scales and in the required condition. We won't be liable for any other loss or damages, unless the loss or damages are caused by our negligence or our breach of these terms and conditions.
We do not accept liability for any errors and omissions and reserve the right to change information, prices, offers, specifications and descriptions. We will endeavour to do our best to correct errors and omissions as soon as practicable after we become aware of them. We shall be under no obligation to dispatch an order for products/offers which have been advertised incorrectly but we shall give you the option to either cancel the order or confirm the order at the correct price.
Price Match & Promotion Terms and Conditions
In order to uphold our `Lowest Price in the UK´ guarantee, we promise to refund you the difference plus 10% if you have bought a product from us and have then found an identical product cheaper elsewhere. Please review the following conditions below to confirm the eligibility of the price match. We ask that you kindly ensure that the competing product fulfils each of the following conditions before proceeding with a `PriceMatch Plus 10%´ claim.
• Products are of the SAME STRENGTH - Price matches cannot be carried out on products of a different specification or ingredient
• UK or Channel Islands Based - The price match company must be UK or Channel Island registered
• IT is NOT an AUCTION - We do not match auction site prices, whether it is `Buy Now´ or similar
• You have EVIDENCE - We politely ask that if you do see the same product cheaper elsewhere, you have quantifiable evidence e.g. a leaflet with the offer, a web address for us to check, a brochure reference etc. Simply claiming that you have `seen´ it cheaper elsewhere does not provide sufficient evidence.
